Practices

LITIGATION

INNOVATING TO PROTECT OUR CLIENTS’ INTERESTS

When we walk up the courthouse steps, we are prepared to win. We have experience managing multi-jurisdictional and parallel proceedings presenting not only legal and financial exposure risks, but also potential reputational damage and loss of customers. As a small firm, we can more easily avoid conflicts of interest and represent both plaintiffs and defendants. On the defense side, we have persuaded dozens of courts to dismiss cases against our clients and affirm their wins on appeal. On the plaintiff’s side, we have secured millions of dollars in judgments and settlements for our clients in serious personal injury and medical malpractice cases, including wrongful death, neurosurgery malpractice, and accidents resulting in brain injuries and complex pain syndrome. We have tried and won ‘bet-the-company’ litigation during our decades of experience defending and prosecuting commercial litigation throughout the United States.

WHITE-COLLAR

DEFENDING CLIENTS ON ALL FRONTS

Levy Firestone Muse attorneys represent companies, executives, and government officials in federal and state criminal matters and investigations conducted by, for example, the SEC, CFPB, IRS, FEC, SBA, various Inspectors General, and the Office of Special Counsel. We are often able to convince criminal investigators not to pursue charges, and when we go to trial, we are prepared to win. Representative matters include convincing the Department of Justice to decline all charges against Paula Broadwell for alleged cyberstalking and allegedly receiving classified information from General David Petraeus, representing Senator Bob Packwood in two separate grand jury investigations that both resulted in no charges, and representing executives in grand jury investigations resulting in no charges.

We have conducted internal investigations on behalf of clients concerned about fraud, embezzlement, and violations of the Foreign Corrupt Practices Act, the UK Anti-Bribery Act, the False Claims Act, healthcare fraud statutes, campaign finance laws, export control laws, and regulations concerning the administration of federal funds. Our internal investigations have included long-term engagements on behalf of the Government of Rwanda’s Ministry of Justice and the Major League Baseball Players Association.

CONGRESSIONAL INVESTIGATIONS

MANAGING HIGH-STAKES RISK IN THE POLITICAL AND MEDIA SPOTLIGHT

Levy Firestone Muse lawyers have participated in congressional investigations from Watergate to the present. Our lawyers have spent decades representing corporations and individuals in congressional investigations, including Iran-Contra, Anita Hill, Filegate, Whitewater, Enron, Fast and Furious, Benghazi, Solyndra, 2016 Election Interference, January 6, and many others. We have also represented clients in congressional inquiries resolved with little to no public attention. We understand that congressional inquiries create unique legal and reputation risks for our clients, and we are experts at managing those risks. LFM partner Bob Muse served as a staff attorney on the Senate Watergate Committee and as general counsel to the Senate Katrina investigation. LFM partner Josh Levy served as counsel to U.S. Senator Charles E. Schumer and to the U.S. Senate Committee on Homeland Security and Governmental Affairs. For over 15 years, Muse and Levy have been teaching a seminar on Congressional Investigations at Georgetown Law.

WHISTLEBLOWER REPRESENTATION

EXPOSING FRAUD AND PROTECTING THE PEOPLE WHO SPEAK THE TRUTH

Levy Firestone Muse attorneys have represented whistleblowers for decades in False Claims Act cases and high-profile, politically sensitive matters. We have won millions of dollars for clients and exposed fraud in government and the private sector while navigating the dangers of taking on powerful interests, including threats to anonymity, reputation, and employment. Among the high-profile whistleblowers our lawyers have represented are Cynthia Cooper, the whistleblower who exposed financial fraud at WorldCom and became Time Magazine’s Person of the Year, and Dinesh Thakur, whose work exposing the adulteration and misbranding of FDA-approved drugs resulted in the largest False Claims Act settlement with a generic drug company in US history.

We have expertise and experience representing whistleblowers in the cryptocurrency industry. In some of the most high-profile enforcement actions by the SEC, CFTC, and DOJ, we have helped crypto whistleblowers maintain anonymity while pursuing substantial awards.
